ImmDef Celebrates Preservation of Birthright Citizenship 

Calls for full reckoning and commitment to repair the damage Donald Trump and Stephen Miller have done to our democracy

LOS ANGELES, CA -  On June 30, 2026, the Supreme Court issued a 6-3 ruling in Trump v. Barbara, affirming that America remains a place where every child born here is recognized as an equal citizen under the U.S. Constitution and that this right cannot be erased by a xenophobic, partisan agenda. The Supreme Court’s decision reaffirms that the people, not the privileged few, shape this nation’s destiny. 

Lindsay Toczylowski, CEO and Co-Founder, Immigrant Defenders Law Center (ImmDef) shared, “This case was never about the law. Stephen Miller knew this racist, xenophobic attack on a core constitutional right would fail in court and he pursued it anyway, because the real objective was to make some citizens seemingly worth less than others. While we are pleased to see that the Court did not hand the Trump administration another politicized win on immigration, we must reflect today on what we have collectively lost as country. Today is a day not to celebrate the Court affirming what we all already knew to be true, but to reflect on the damage this case has done to our democracy and what we are going to do to fight back. Even as birthright citizenship prevailed, the harm is real, and it demands a response from all of us. The struggle for the future of our country is a fight we can win but only if we channel our rage at what happened in this case into action for a more just future.”   

“The Fourteenth Amendment enshrined a clear and powerful promise: every person born in this country is a citizen of it,” said Alvaro M. Huerta, Director of Litigation and Advocacy at ImmDef. “For more than a century and a half, our laws have reaffirmed that fundamental right. Today’s ruling is a long‑overdue message to Trump: no president can pretend to erase a bedrock constitutional guarantee with the flick of a pen. We’re relieved that the Supreme Court firmly rejected the Trump administration’s overreach and reaffirmed what, frankly, should never have been in question. Birthright citizenship is not up for debate.”
