ImmDef Decries SCOTUS’ Decision to Hinder Nationwide Injunctions in Birthright Citizenship Ruling


LOS ANGELES, CA - On Friday, June 27, 2025, the conservative super majority of the Supreme Court of the United States issued a ruling that limits the use of nationwide injunctions in challenges to Trump’s executive order against birthright citizenship. The Court did not rule on whether the executive order is constitutional.


In response to this order, Lindsay Toczylowski, CEO and President of Immigrant Defenders Law Center (ImmDef), said, “No matter what Stephen Miller instructs President Trump to do, they are not the ones who get to decide who is an American. The U.S. Constitution, in plain language, enshrines the right of citizenship to all children born on U.S. soil. Nothing about today’s decision changes that. The Supreme Court has only fueled further uncertainty and chaos in our courts. The Justices chose to forfeit the power of the judiciary and submit to Trump’s unlawfulness, but we do not. This fight is far from over. This is a moment to double down on defending our communities and the most vulnerable among us. Today’s decision is another opportunity to plant our feet on the right side of history and forge ahead towards a more just future for all children, a future where everyone’s constitutional rights are fully recognized and protected.”


Director of Litigation and Advocacy Alvaro M. Huerta stated, “The Supreme Court is ceding the judicial branch’s power and shirking its constitutional obligation to provide checks and balances against the lawlessness of the executive branch. Birthright citizenship is a bedrock principle of our democracy, and there is no question that the Constitution makes it the law of the land. Yet the nation’s highest court allowed the President, through executive fiat, to say what he believes the law is and require anyone who disagrees to challenge him in court. At the same time, the ruling ties judges’ hands to prevent the President’s unlawful actions from harming everyone else. As Justice Sotomayor and Justice Jackson’s dissents both argue, the Court’s decision invites the government to bypass the Constitution. But unlike the Court, we will not cede our power--the people’s power--to hold our government accountable.”
