In 2017, the City of Santa Ana became the first city in Orange County to designate funds to help unauthorized immigrants facing deportation receive proper legal help. Santa Ana is one of the first dozen cities across the country to join the Vera Institute of Justice’s SAFE (Safety and Fairness for Everyone) Network, a group of communities dedicated to the goal of publicly funded universal representation. Immigrants hold an important place in the fabric of Santa Ana’s community. They strengthen the city through their economic contributions and strong relationships. Santa Ana’s efforts to uphold due process for ALL through its legal defense fund is helping to restore our justice system, and it helps keep more people safe.
ImmDef serve as the City's legal service provider. to provide immigration legal defense services. These services are provided under the universal representation model, which is publicly funded deportation defense for all. We provide full-scale removal defense to Santa Ana community members under this grant and will represent them through final adjudication of their immigration case, which includes all EOIR hearings (detained and released), bond, USCIS applications and a limited number of BIA appeals. Generally, immigrants facing deportation do not get appointed an attorney even if they are detained. Many people in deportation proceedings have valid claims to remain in the United States but find it nearly impossible to present these claims without proper legal representation.
