San Diego, CA – 21 de Marzo 2022: Hoy se cumple el segundo aniversario de la invocación del Título 42 para bloquear y expulsar a las personas que buscan seguridad en nuestra frontera sur. Este uso dañino, y posiblemente ilegal, del Título 42 continúa bajo la Administración Biden.
El Consorcio de Derechos de los Inmigrantes de San Diego (SDIRC, en inglés) se unió a un llamado nacional a la acción para unirse con otras organizaciones de derechos humanos para pedir el fin del uso del Título 42 para excluir a los solicitantes de asilo y otras personas que buscan protección humanitaria. Esta mañana, Defend Asylum realizó un evento paralelo en Tijuana para elevar las voces, compartir las experiencias vividas y implorar a la Administración Biden que ponga fin al Título 42 para los solicitantes de asilo y otras personas que huyen de la persecución y la violencia.
El Título 42 es una provisión oscura invocada por la Administración Trump y continuada por la administración Biden, que niega la entrada a inmigrantes y solicitantes de asilo bajo el falso pretexto de detener la propagación de COVID-19. De hecho, los expertos en salud pública han declarado que no hay pruebas que justifiquen rechazar a los solicitantes de asilo y a los menores no acompañados bajo el pretexto de problemas de salud pública.

"SDIRC pide a la Administración Biden que ponga fin al Título 42 HOY. Esta es una política racista implementada por la Administración Trump y llevada adelante por la Administración Biden. El Título 42 continúa infligiendo un daño significativo a los solicitantes de asilo de color.
He escuchado de miles de solicitantes de asilo que arriesgan sus vidas cruzando el desierto y el océano para buscar una vida de prosperidad y seguridad en un país que está haciendo todo lo posible para mantenerlos fuera y mantenerlos en un limbo peligroso en los centros de detención sin ninguna esperanza de una audiencia de asilo.
La ironía es que miles de personas cruzan la frontera sur todos los días para gastar dinero en centros comerciales, bodegas y vacaciones, pero esta política impide que las personas que huyen de la violencia y la pobreza encuentren seguridad y aseguren su futuro en este país que fue construido sobre la trabajo y la esperanza de inmigrantes, migrantes y solicitantes de asilo.

Lilian Serrano, Co-chair de Coalición de Comunidades de la Frontera Sur (SBCC) y Codirectora del Universidad Popular dijo:
"La Administración Trump convirtió a COVID-19 en un arma al usar el Título 42 para continuar difundiendo mensajes racistas sobre inmigrantes de color que traen enfermedades a este país. Después de más de dos años, seguimos escuchando estos horribles mensajes, pero la política sigue vigente. Nuestra economía y el sustento de las familias que viven en las comunidades fronterizas se fortalecen cuando abrimos la puerta a la oportunidad.
Los solicitantes de asilo arriesgan sus vidas para huir de la violencia y la pobreza de sus países de origen para encontrar seguridad, acogida e inclusión en este país. Hemos escuchado numerosas historias de familias cuya raza, género o identidad sexual las pone en riesgo de violencia y opresión en su país de origen. Vienen aquí para buscar asilo, que sus casos sean escuchados con el debido proceso y quieren hacer su parte para ayudar a que las comunidades fronterizas prosperen. Desde San Diego hasta Brownsville, nuestras organizaciones apoyan la promesa de prosperidad y condenamos el Título 42. Debe terminar hoy. "
Ian Seruelo, representante laboral del Consorcio de Derechos de los Inmigrantes de San Diego (SDIRC) y miembro de la Alianza Laboral de Asiáticos Americanos San Diego (APALA San Diego) dijo:
"La Administración Biden está fallando miserablemente en cumplir su promesa de campaña de reiniciar el proceso de asilo utilizando una política racista para excluir principalmente a los solicitantes de asilo de color. La pandemia mundial se está utilizando como pretexto para mantener el Título 42 en vigor, sin embargo, no hay ciencia que respalde las afirmaciones racistas de que los inmigrantes de color son portadores de COVID-19 más que cualquier otra población. Cuando rechazamos a los solicitantes de asilo, estos migrantes se ven obligados a vivir en condiciones peligrosas en la frontera y, lo que es peor, son víctimas de pandillas y organizaciones criminales.

Hoy, el gobierno de los Estados Unidos continúa expulsando ilegalmente a familias e individuos sin el debido proceso en absoluto a un peligro grave, ya sea a sus países de origen o a México.
Justo este fin de semana visitamos un refugio para brindar servicio legal y la mayoría de las personas están allí específicamente porque el Título 42 les ha impedido buscar protección en los Estados Unidos. SDIRC Marks Two Years of Biden Administration's Title 42 Trap

San Diego, CA – Monday, March 21, Today marks the two year anniversary of the invocation of Title 42 to block and expel people seeking safety at our southern border. This harmful, and possibly illegal, use of Title 42 continues under the Biden Administration.
The San Diego Immigrant Rights Consortium (SDIRC) joined a national call to action to rally with other human rights organizations and advocacy groups to call for an end to the use of Title 42 to exclude asylum seekers and others seeking humanitarian protection. A parallel event was held in Tijuana earlier this morning by Defend Asylum to uplift the voices, share the lived experiences and to implore the Biden Administration to end Title 42 for asylum seekers and others fleeing persecution and violence.
Title 42 is an obscure provision that was invoked by the Trump Administration, and continued by the Biden administration, that denies entry to immigrants and asylum seekers under the false-pretense of stopping the spread of COVID-19. In fact, public health experts have stated there is no evidence to justify turning away asylum seekers and unaccompanied minors under the guise of public health concerns.
Dulce Garcia, Chair of the San Diego Immigrant Rights Consortium (SDIRC) and Executive Director of Border Angels said:
"SDIRC calls on the Biden Administration to end Title 42 TODAY. This is a racist policy implemented by the Trump Administration and carried forward by the Biden Administration. Title 42 continues to inflict significant harm against black and brown asylum seekers.
I have heard from thousands of asylum seekers risking their lives crossing the desert and the ocean to seek a life of prosperity and safety in a country that is doing everything it can to keep them out and keep them in a perilous limbo at detention centers without any hope for an asylum hearing.
The irony is that thousands of people cross the southern border every day to spend money at shopping malls, wineries and on vacations yet this policy prevents people who are fleeing violence and poverty to find safety and secure their future in this country which was built on the labor and the hope of immigrants, migrants and asylum seekers.
All these families want is to present themselves at the port of entry and to have their asylum cases heard with all due process. All they want is a beacon of hope and an opportunity to survive. What they are getting now is a policy that is designed to keep them away from the promise that this country is supposed to symbolize. We must end Title 42 today."

"The Trump Administration weaponized COVID-19 by using Title 42 to continue to spread racist messaging about black and brown immigrants bringing disease to this country. After more than two years, we continue to hear these horrific messages yet the policy remains in place. Our economy and the livelihood of families living in border communities are all made stronger when we open the door to opportunity.
Asylum seekers put their lives at risk to flee the violence and poverty of their home countries to find safety, welcoming and inclusion in this country. We have heard numerous stories of families whose race, gender or sexual identity put them at risk of violence and oppression in their home country. They come here to seek asylum, have their cases heard with due process and they want to do their part to help border communities thrive.
From San Diego to Brownsville, our organizations support the promise of prosperity and we condemn Title 42. It must end today."
Ian Seruelo, Labor Representative of SDIRC and member of the Asian Pacific American Labor Alliance San Diego (APALA San Diego) said:
"The Biden Administration is failing miserably in keeping its campaign promise to restart the asylum process using a racist policy to exclude primarily black and brown asylum seekers. The global pandemic is being used as a pretext to keep Title 42 in place, however there is no science to back the racist claims that black and brown migrants are carriers for COVID-19 more than any other population. When we turn away asylum seekers, these migrants are forced to live in dangerous conditions at the border and worse is that they are victimized by gangs and criminal organizations.
Carrying on this policy was never about CDC guidelines or ensuring public safety and health. We know that this was a racist policy designed to harm specific populations by preventing them from exercising their right to apply for asylum. The Biden Administration is failing to honor its commitment to the international community. This is morally inconsistent with what this country represents and legally inconsistent with our obligation under international law. This continued use of Title 42 exacerbates the humanitarian crisis at the southern border which is of our own making, and the Biden Administration has a critical role to be on the right side of history by ending Title 42."
Lindsay Toczylowski, executive director and co-founder, Immigrant Defenders Law Center (ImmDef) said:
"Today marks a grim milestone: the second anniversary of the implementation of the cruel and inhumane Title 42 policy. Today the U.S. government continues to unlawfully expel families and individuals with absolutely no due process to grave danger, either to their countries of origin or to Mexico.
Just this weekend we visited a shelter to provide legal service and most of the people are there specifically because Title 42 has prevented them from seeking protection in the United States. I sat with one young mom and her daughter who tearfully told me about fleeing Honduras after her family was targeted by violence, and the fear she lives in every day after seeing one of her persecutors in Mexico. She cried as she told me about how sick her daughter is and how they desperately want to be able to get to safety. She has family in the US, but she is unable to get to them or keep her daughter safe because of Title 42. She is just sitting at the border, in agony waiting to see whether violence claims her first or the Biden Administration allows her to seek safety.
As I counseled her on her options I had to tell the truth: there really is no safe option available to you because of Title 42. Seeking humanitarian parole should be an option, but it is often not granted even in the most extreme cases.
The Biden administration has a duty and responsibility to uphold refugee law and establish a safe and fair asylum process at the border. All people seeking protection at our border should be welcomed with dignity, and that means being given meaningful access to due process and asylum protections. Seeking asylum is a human right."
